APPALACHIAN REGIONAL COMMISSION (ARC) COMBINED NOTICE NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST A RELEASE OF FUNDS City of West Point Post Office Box I117 580 Commerce Street West Point, MS 39773 June 10, 2020 Contact: Harmon A. Robinson, Mayor (662) 494-2573 TO ALL INTERESTED AGENCIES, GROUPS, AND PERSONS These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of West Point, Mississippi. REQUEST FOR RELEASE OF FUNDS On or after June 26, 2020, the City of West Point, Mississippi will submit a request to the Mississippi Development Authority for the release of funds under the Appalachian Regional Development Act of 1965, Public Law 89-4, as amended; Appalachian Regional Development Reform Act Of 1998, Public Law 105-393, to undertake the following project: Project Title: Prairie Belt Power Site Wastewater Improvements Purpose: The City of West Point proposes to complete Phase II of an industrial sewer improvements project to serve the Prairic Belt Power Site. Construction will include installation of 2.500 lincar feet of 12" gravity-fed sewer collection system in the newly established industrial park. Location: The project will include installation of a waste water collection system adjacent to Yokohama Boulevard within the Prairie Belt Power Site. Estimated Cost: S625,000.00; with $500,000.00 from the Appalachian Regional Commission (ARC). The activities proposed comprise a project for which a Finding of No Significant Impact on the environment was published on June 10, 2020. An Emvironmental Review Record (ERR) that documents the environmental determinations for this project is on file at the West Point City Hall, Office of the City Clerk, 580 Commerce Street, West Point, Mississippi. 39773 and may be examined or copied weekdays 8:00 AM to 4:00 PM (Monday - Friday). FINDING OF NO SIGNIFICANT IMPACT The City of West Point has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the West Point City Hall, Office of the City Clerk in West Point at the aforementioned address. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the City of West Point, at the aforementioned address or directly to the West Point City Clerk's office. All comments received by on or before June 26, 2020, will be considered by the West Point Mayor and Board of Selectmen prior to submission of a request for release of funds. RELEASE OF FUNDS The City of West Point, Mississippi certifies to the Mississippi Development Authority that Harmon A. Robinson, in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Mississippi Development Authority's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of West Point, Mississippi to use ARC program funds. OBJECTION TO RELEASE OF FUNDS The Mississippi Development Authority will accept objections to its release of funds and the City of West Point's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following basis: (a) the certification was not executed by the certifying officer of the City of West Point, Mississippi: (b) the City of West Point, Mississippi has omitted a step or failed to make a decision or finding required by the Appalachian Regional Commission: (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by the ARC before approval of a release of funds by the Mississippi Development Authority; or (d) another Federal Agency has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures and shall be addressed to the: Community Services Division, Mississippi Development Authority, P.O. Box 849, Jackson, Mississippi 39205-0849, (Attention: Ray Robinson). Potential objectors should contact the Mississippi Development Authority to verify the actual day of the objection period.
